1. Acceptance of these Terms
These Terms & Conditions govern access to and use of the Kushmahen Agro Tech website, seller and buyer account features, agri marketplace, trade-request tools, transport coordination and related services. By using the website, creating an account, posting a listing or requirement, submitting an enquiry, making a payment or confirming a service, you agree to these Terms and our Privacy Policy.
2. Eligibility and account responsibility
- You must be legally capable of entering the relevant commercial transaction.
- You must provide accurate, current and complete information.
- You are responsible for protecting your mobile device, OTP and account access.
- You must promptly update inaccurate profile, business, product or requirement information.
- Kushmahen may request identity, KYC, GST, Udyam or other verification where reasonably necessary.
3. Managed marketplace model
Kushmahen is designed as a managed marketplace. Public listings may show commodity, location, quantity, grade, price and an internal listing/account identifier, while private contact information may remain hidden.
Buyers and sellers may be required to route trade requests, quotations and commercial coordination through Kushmahen. Users must not attempt to misuse platform data or technical means to obtain another user's protected contact information.
4. Seller listings and buyer requirements
Sellers are responsible for the truthfulness of product descriptions, images, price, quantity, grade, condition, ownership/authority to sell and applicable legal compliance. Buyers are responsible for the accuracy of required quantity, quality specification, target price, delivery location and purchase authority.
Kushmahen may review, pause, reject, edit for formatting, or remove content that appears misleading, unlawful, prohibited, unsafe, duplicated, expired or inconsistent with platform standards.
5. Prices, estimates and quotations
Prices displayed in marketplace listings, sample activity, route estimators or other website areas may be indicative. A transaction is not final merely because a price appears on the website or an enquiry is submitted.
A binding commercial commitment arises only when the relevant price, quantity, taxes, quality, payment terms, delivery/transport conditions and other material terms are confirmed through an accepted quotation, order confirmation, invoice, booking confirmation or another clear confirmation record.
6. Payments, taxes and invoices
Where online payment is enabled, payment may be collected through a third-party payment gateway. Users must use a payment method they are authorised to use. Applicable taxes, fees, transport charges, loading/unloading charges, tolls or other costs should be stated in the relevant quotation or confirmation where applicable.
Failed, duplicate, reversed or disputed payments are handled in accordance with the Refund & Cancellation Policy and the rules of the relevant bank or payment provider.
7. Commodity trade responsibilities
Unless expressly agreed otherwise in writing, the seller remains responsible for supplying goods that match the confirmed description and specification, and the buyer remains responsible for timely acceptance and payment under the confirmed terms.
Because agricultural commodities can vary by grade, moisture, size, origin, season and condition, users should ensure that material specifications and inspection/acceptance requirements are clearly agreed before dispatch.
8. Transport and delivery
Transport availability, pricing and delivery time can depend on origin, destination, vehicle type, load weight, road conditions, seasonality, permits, tolls and availability. Any route estimator is indicative only.
Confirmed transport services are additionally governed by the Shipping & Transport Policy and the specific booking or quotation accepted for the shipment.
9. Cancellations and refunds
Cancellation eligibility and refund amounts depend on the stage of the transaction or transport service, work already performed, payment status, committed third-party costs and other confirmed terms. Please review the Refund & Cancellation Policy.
10. Prohibited conduct
- Posting false, misleading, stolen, unlawful or unauthorised goods or requirements.
- Impersonating another person or business.
- Attempting to bypass protected-contact controls through scraping, hacking or misuse.
- Using the website to distribute malware, spam, abusive material or unlawful content.
- Manipulating reviews, transactions, payments or verification documents.
- Using another person's payment instrument or credentials without permission.
11. Intellectual property
The website design, brand elements, text, graphics, software and platform materials owned by Kushmahen are protected by applicable intellectual-property laws. Users retain responsibility for content they upload and represent that they have the right to provide it for use on the platform.
By submitting listing images or descriptions, you grant Kushmahen a limited right to host, display, format and use that content for operating and promoting the relevant marketplace listing or service.
12. Platform availability and changes
We may update, suspend or discontinue website features for maintenance, security, operational or legal reasons. We do not guarantee uninterrupted availability of every feature at all times.
13. Disclaimers and limitation
Kushmahen uses reasonable efforts to coordinate marketplace and transport activity, but market prices, crop quality, user-supplied information, third-party transport operations and external payment networks may change or fail for reasons outside our direct control.
To the maximum extent permitted by applicable law, liability will be limited to losses directly arising from the specific service for which Kushmahen is legally responsible. Nothing in these Terms excludes liability that cannot legally be excluded.
14. Force majeure
Delays or non-performance caused by events beyond reasonable control—including severe weather, floods, strikes, road closures, government restrictions, civil disturbance, system outages or similar events—may extend timelines or require a booking to be rescheduled or cancelled.
15. Complaints, disputes and governing law
If you have a complaint, first contact Kushmahen through the Contact Us page or by email so the issue can be reviewed using the relevant listing, booking, payment or transaction records.
These Terms are governed by the laws of India. Any unresolved dispute will be subject to the jurisdiction of a court or forum having lawful jurisdiction under applicable Indian law, unless another dispute-resolution process is expressly agreed in writing.
